Understanding Homeschooling in Uganda

Legal Status of Homeschooling

Homeschooling is not currently recognized as a legal form of education in Uganda. On November 20, 2024, during a session with Parliament’s Education Committee, Attorney General Kiryowa Kiwanuka clarified that parents are required by law to enroll their children in formal schools, and homeschooling is not provided for under existing legislation.

This statement was made in response to a question from Rwampara Woman MP Molly Kamukama, who asked why the National Teachers Bill, 2024 did not address the regulation of homeschooling, given its growing popularity. The Attorney General emphasized that teaching children requires professional qualifications, and any future provision for homeschooling would require a formal regulatory framework developed by the Ministry of Education.

⚠️ As of now, homeschooling is considered illegal in Uganda.

However, some organizations continue to advocate for parental rights in education under Uganda’s Constitution. For example, the Home School Legal Defense Association (HSLDA) and others cite the following provisions:

  • Article 31(4): “It is the right and duty of parents to care for and bring up their children.”
  • Article 34(2): “A child is entitled to basic education which shall be the responsibility of the State and the parents of the child.”

Many interpret these articles as supporting parents’ right to direct their children’s education, including the possibility of homeschooling. While these interpretations are not yet recognized in law or practice, advocacy efforts are ongoing to clarify and potentially expand educational freedoms.
